Terms of Service

These Terms of Service ("Terms") govern your use of eluxena.com (the "Site") and purchases of goods from the Site operated by JOLI d.o.o. ("we", "us", "Eluxena"), a limited liability company registered in Slovenia, whose details appear in our Impressum.

By using the Site or placing an order, you agree to these Terms.

1. Who can order

You may place an order if you are at least 16 years old and have the legal capacity to enter into a contract in your country of residence.

2. How a contract is formed

When you submit an order through our checkout, that is an offer to buy. A binding contract is formed when we send you an Order Confirmation by email indicating the order has been accepted and, where applicable, dispatched. If an item in your order is unavailable we will tell you and refund any amount already paid for that item.

3. Prices and payment

• Prices are shown in the currency selected at the top of the Site, inclusive of Slovenian VAT (DDV) at the current rate, unless a B2B account is marked as VAT-exempt.
• We reserve the right to correct pricing errors. Where a price was obviously wrong (for example, a €1 item that sells at €100), we will cancel the order and refund you before dispatch.
• Payment is due at the time of order. We accept the payment methods shown at checkout.
• Title to the goods passes to you on full payment and on delivery to you or your nominated carrier.

4. Discounts and reference prices (Omnibus Directive)

When a product is shown with a strikethrough "was" price, the reference price is the lowest price at which we offered that product in the 30 days immediately before the discount started, in line with Article 6a of Directive 98/6/EC as amended by Directive 2019/2161. Price history for ongoing discounts is kept in our systems and available on request.

5. Delivery

See our Shipping Policy for countries, times, and costs. Delivery estimates are indicative; we will let you know without undue delay if a firm date cannot be met, and you may withdraw from the affected order if we miss a reasonable additional period you grant us (Slovenian ZVPot-1 Art. 42).

6. Right of withdrawal and returns

You have a 14-day right of withdrawal for any consumer order. See our Returns & Refund Policy for the procedure, exclusions (sealed hygiene products), and the model withdrawal form.

7. Legal guarantee of conformity

Every item carries the statutory legal guarantee of conformity for at least two years from delivery (Directive (EU) 2019/771; ZVPot-1 Art. 72). This is independent of the 14-day withdrawal right and of any commercial manufacturer warranty.

8. Your account

If you create an account, you are responsible for keeping your password confidential and for activity under your account. Tell us immediately at hello@lemonabird.com if you believe it has been compromised. You can delete your account at any time from your account page or by emailing us.

9. Acceptable use

You agree not to:

• use the Site for anything illegal or to infringe anyone's rights,
• reverse-engineer, scrape, or overload the Site,
• submit false, misleading, or abusive reviews (see our Reviews Policy).

We may suspend or terminate access for serious or repeated breaches.

10. Intellectual property

The Site, its content, and Eluxena's trade marks and brand identity are owned by us or our licensors. Product images and descriptions are licensed from the brands we resell; they may not be reproduced without permission. You may use the Site for personal, non-commercial shopping.

11. Liability

Nothing in these Terms limits any right you have as a consumer under mandatory law. Subject to that:

• We are not liable for indirect or consequential losses.
• For direct losses, our total liability to you is capped at the amount you paid for the affected order.
• We are not liable for delay or failure caused by events beyond our reasonable control (force majeure).

Nothing excludes or limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under Slovenian law.

13. Changes to these Terms

We may update these Terms from time to time. The effective date above is always current. The Terms in force at the time you place an order govern that order.

14. Governing law and disputes

These Terms and any contract formed under them are governed by Slovenian law, without prejudice to any mandatory consumer-protection rights of the country where you have your habitual residence (Article 6 of Regulation (EC) 593/2008, Rome I).

Disputes that cannot be resolved informally may be brought before the courts of Celje, Slovenia, save that you, as a consumer resident elsewhere in the EU, may also bring proceedings in the courts of your country of residence.

Before going to court, we encourage you to use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
